It’s members can explore various communities, united through Community Connectors such as arts, cuisine, music, etc., exchange knowledge by reading original information bytes/articles, contribute their authentic insights(by invitation) and celebrate amongst communities through various community level engagements and events.

What are Community Connectors?

Community Connectors are the bonds connecting communities. These includes Festival, Language, Music(Instrument, Genre), Cuisine(Recipe, About the Food), Arts, Clothing, Traditions, Religion, Architecture , Education, Location(Society, City, Country)

Community Explorers

Community Explorers are members(/users) who can explore the platform, choosing a mix of communities and conectors to enrich their understanding about a particular community. They can also participate in various community level engagements and events.

Community Builders

Community Builders are powered members(/users) and upgraded by invite. They are basically our content creators who leverage connectors to build their own community or even contribute/enrich towards the existing community

Community Multipliers

Community Multipliers are special members(/users) who bring the power of multiplicity on the efforts made by community builders. Multiplicity can be achieved by organising events, group activities, gatherings, gamification, etc. around a particular community connected with a connector.

CommunityCX (“we” or “us” or “our”) respects the privacy of our users (“user” or “you”). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website and our mobile application, including any other media form, media channel, mobile website, or mobile application related or connected thereto (collectively, the “Site”). Please read this privacy policy carefully.

We reserve the right to make changes to this Privacy Policy at any time and for any reason. We will alert you about any changes by updating the “Last Updated” date of this Privacy Policy. Any changes or modifications will be effective immediately upon posting the updated Privacy Policy on the Site, and you waive the right to receive specific notice of each such change or modification.

You are encouraged to periodically review this Privacy Policy to stay informed of updates. You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised Privacy Policy by your continued use of the Site after the date such revised Privacy Policy is posted.

The information we may collect includes personally identifiable information, such as your name, shipping address, email address, and telephone number, and demographic information, such as your age, gender, hometown, and interests, that you voluntarily give to us when you register with the Site or our mobile application, or when you choose to participate in various activities related to the Site and our mobile application, such as online chat and message boards or when you expressly grant us access or permission. You are under no obligation to provide us with personal information of any kind, however your refusal to do so may prevent you from using certain features of the Site and our mobile application. Device information, such as your mobile device ID, model, and manufacturer, and information about the location of your device, if you access the Site from a mobile device.

3. Use of Your Information

Having accurate information about you permits us to provide you with a smooth, efficient, and customized experience. Specifically, we may use information collected about you to:

  • Administer promotions, and contests.
  • Create and manage your account.
  • Deliver targeted advertising, coupons, newsletters, and other information regarding promotions and the Site and our mobile application to you.

This includes exchanging information with other entities for fraud protection and credit risk reduction. 

4.2 Third-Party Service Providers

We may share your information with third parties that perform services for us or on our behalf, including payment processing, data analysis, email delivery, hosting services, customer service, and marketing assistance.  

4.3 Marketing Communications

With your consent, or with an opportunity for you to withdraw consent, we may share your information with third parties for marketing purposes, as permitted by law. 

4.4 Interactions with Other Users

If you interact with other users of the Site and our mobile application, those users may see your name, profile photo, and descriptions of your activity, including sending invitations to other users, chatting with other users, liking posts, following blogs. 

4.5 Online Postings

When you post comments, contributions or other content to the Site or our mobile applications, your posts may be viewed by all users and may be publicly distributed outside the Site and our mobile application in perpetuity. 

4.6 Third-Party Advertisers

We may use third-party advertising companies to serve ads when you visit the Site. These companies may use information about your visits to the Site and our mobile application and other websites that are contained in web cookies to provide advertisements about goods and services of interest to you.

4.7 Affiliates

We may share your information with our affiliates, in which case we will require those affiliates to honour this Privacy Policy.

4.8 Business Partners 

We may share your information with our business partners to offer you certain products, services or promotions.

4.9 Other Third Parties

We may share your information with advertisers and investors for the purpose of conducting general business analysis. We may also share your information with such third parties for marketing purposes, as permitted by law.

5.1 Cookies and Web Beacons

We may use cookies, web beacons, tracking pixels, and other tracking technologies on the Site and our mobile application to help customize the Site and our mobile application and improve your experience. When you access the Site, your personal information is not collected through the use of tracking technology. Most browsers are set to accept cookies by default. You can remove or reject cookies, but be aware that such action could affect the availability and functionality of the Site. You may not decline web beacons. However, they can be rendered ineffective by declining all cookies or by modifying your web browser’s settings to notify you each time a cookie is tendered, permitting you to accept or decline cookies on an individual basis.
We may use cookies, web beacons, tracking pixels, and other tracking technologies on the Site and our mobile application to help customize the Site and our mobile application and improve your experience. 

5.2 Website Analytics

We may also partner with selected third-party vendors to allow tracking technologies and remarketing services on the Site and our mobile application through the use of first party cookies and third-party cookies, to, among other things, analyze and track users’ use of the Site and our mobile application, determine the popularity of certain content and better understand online activity. 

6. Security

We use administrative, technical, and physical security measures to help protect your personal information. While we have taken reasonable steps to secure the personal information you provide to us, please be aware that despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse. Any information disclosed online is vulnerable to interception and misuse by unauthorized parties. Therefore, we cannot guarantee complete security if you provide personal information. For the avoidance of doubt, if any personal information is compromised despite our efforts to prevent the occurrence of the same, you shall not hold us liable for such breach of privacy protection under this privacy policy.

7. Policy for Children

We do not knowingly solicit information from or market to children under the age of 18. However, if anyone below the age of 18 years subscribes to our application, then we would require a consent from such subscriber’s parent or guardian permitting the collection, storage and sharing of personal information of such subscriber as per the terms of this Privacy Policy. If you are a parent or guardian and have become aware of any data that your child has provided and we have collected from children under age 18 years, please contact our Grievance Officer via email at hello@communitycx.net and we will take appropriate action for deletion of such information. 

7.1 Emails and Communications

If you no longer wish to receive correspondence, emails, or other communications from us, you may opt-out by:

  • Noting your preferences at the time you register your account with the Site.
  • Logging into your account settings and updating your preferences.
  • Contacting us using the contact information provided below

8. Exercise Your Rights

We respect your right to be informed, access, correct, request deletion or request restriction, portability, objection, and rights in relation to automated decision making and profiling, in our usage of your personal information as required by applicable law. We also take steps to ensure that the personal information we collect is accurate and up to date and deleted when data is no longer required. Your rights are subject to defined conditions and feasibility to exercise such rights and subject to geo locations applicability.

Your Rights:

  • You have the right to know what personal information we maintain about you subject to availability.
  • You have the right to have your grievances resolved.
  • You have the right to nominate another individual to exercise your rights in case of your death or incapacity. 
  • We will provide you with a copy of your personal information in a structured, commonly used and machine-readable format on request subject to availability.
  • If your personal information is incorrect or incomplete, you have the right to review and ask us to update it.
  • You have the right to object to our processing of your personal information only if the data is processed.
  • You can also ask us to delete or restrict how we use your personal information, but this right is determined by applicable law and may impact your access to some of our services.
  • You have the right to access your personal information which may vary from visitor to visitor.
  • You have a right to object to processing of your personal information where it is so conducted by automated means and involves any kind of decision making subject to discovery that your data was used for automated means.

All request for any of these rights should be directed to the Grievance Officer (whose details are mentioned below in Section 12) via email.

We will also inform you if we are unable to delete your information for any reason. You will at all times have the ability to delete your account, and if you choose to do so, we will delete all information you have provided to us in accordance with the Privacy Policy, unless we are required to retain it by law.

If you have given your consent for the processing of your information for specific purposes, you can withdraw this consent at any time by contacting the Grievance Officer via email. Please note, however, that this may affect our ability to offer Services to you. In some cases, if we are not allowed to process your information, we may need to terminate the Services we provide to you, which may result in the deletion of your account by us.

You also have the right to lodge a complaint via email with the Grievance Officer (details provided below), and subsequently to the Data Protection Board, in case your complaint remains unresolved.

9. How we Store and Retain your Information

We will strictly control access to the information and will review such access control from time to time. We will retain and use your information until (a) the purpose of processing such information is achieved, and when the purpose is achieved, such information will be removed from our systems or anonymised; or (b) you withdraw your consent for the processing of such information in accordance with your rights mentioned above.

We may retain the information for a longer period if such retention is required or permitted by law.

10. How we Disclose/Transfer your Information

All information that we collect may be disclosed or transferred under the following circumstances, to the categories of entities identified below:

  • Your information may be disclosed or transferred to our corporate affiliates or any future partners or entities, in connection with providing Services, to the extent applicable;
  • Your information may be disclosed or transferred to vendors, service providers and other third-party entities engaged by us to provide services such as user registration, verification, and in-App communication;
  • Your information may further be disclosed or transferred by such third-party entities engaged by us;
  • Your information may be disclosed or transferred to payment service providers in order to process your payments in connection with the Services;
  • Your information may be disclosed or transferred to dashboard and analytics vendors for the purposes of gathering analytics on the App and/or the website;  
  • Your information may be disclosed and transferred to respond to law enforcement requests or where required to be provided under applicable laws, court orders, or government regulations; and
  • Where we need to share your information with any other third parties, we will obtain your consent before doing so.  

11. Translation

This Privacy Policy is drafted in English and translations may be provided in other languages upon your request. To request a translated version, submit a request via email to the Grievance Officer (details provided below), and if feasible, your request will be addressed within 30 working days of submission.

Terms of Use

The CommunityCX Platform is owned and operated by CommunityCX (hereinafter referred to as the “CommunityCX”), an initiative owned and operated by Shubham Vertika, residing in Gurugram, Haryana.

By registering on or using the CommunityCX Platform or availing the services, you agree to be bound by the Terms of Use. 

The Terms of Use and any documents incorporated in these Terms of Use may be revised, modified, or replaced in their entirety, by us, at its sole discretion, from time to time. We encourage you to periodically review them whenever accessing or using the CommunityCX Platform to be continuously aware of any updates to these Terms of Use. Your continued use of the CommunityCX Platform following any changes to the Terms of Use will mean that you accept and agree to such any modifications.  In addition, when using the CommunityCX Platform, you will be subject to any posted guidelines, supplementary terms, policies, or disclaimers made available or issued by us from time to time, including but not limited to the Privacy Policy. All such supplementary terms, policies, guidelines or disclaimers are hereby incorporated by reference into these Terms of Use. 

The terms “you” and “your” hereunder refer to the User.

The terms “we”, “us”, and “our” refer to CommunityCX .

1. ACCOUNT AND ELIGIBILITY

By accepting these Terms of Use, you represent and warrant that you have the right, authority, and legal capacity to accept these Terms of Use. If, at any time, we are of the opinion that you do not satisfy the eligibility criteria, or that you have made any misrepresentation about your eligibility, we retain the right to disable your access to the CommunityCX Platform immediately and our partner third parties would handle any transactions already entered into in accordance with their policies in relation to the same.

Your mobile phone number and/or e-mail address is treated as your primary identifier on the CommunityCX Platform. It is your responsibility to ensure that your mobile phone number and your email address is up to date on the CommunityCX Platform at all times. You agree to notify us promptly if your mobile phone number or e-mail address changes.

You agree that we shall not be liable or responsible for the activities or consequences of use or misuse of any information that occurs under your display name in cases where you have failed to update your revised mobile phone number and/or e-mail address on the CommunityCX Platform. Also, you will be solely responsible for publishing any content under CommunityCX Platform.

2. COMMUNICATIONS

When you use the CommunityCX Platform or send e-mails or other data, information or communication to us, you agree and understand that you are communicating with us through electronic records and you consent to receive communications via electronic records from us periodically and as and when required. We or our affiliates, consultants and advisors may communicate with you by mobile notification, email, phone or by such other mode of communication, electronic or otherwise. If, at any time, CommunityCX is unable to contact you for a period of 1 month, it retains the right to assume you are an inactive user and disable your access to the CommunityCX Platform immediately. 

If you have registered your phone number on the ‘Do Not Disturb’ registers you should take necessary steps to enable us or our affiliates, consultants and advisors to contact you by phone, SMS or by such other mode of communication. You should take necessary steps to ensure that no such communication is registered as a complaint with the relevant authorities for the same. You can write to us at hello@communitycx.net to unsubscribe from receiving certain data or communication.

3. COMMUNITYCX PLATFORM SERVICES

Before you can use the CommunityCX Platform, you will need to register to become a member by creating an Account. In order to become a member you must: (A) be at least 18 years old or the age of majority to legally enter into a contract under the laws of your home country; and (B)  be legally permitted to use the CommunityCX Platform by the laws of your home country.

You can create an Account via manual registration, or by using your social media login details. If you create an Account using your social media login details, you authorize us to access, display and use certain information from your social media account. 

Unfortunately, we cannot allow you to use another person’s Account or to share your Account with any other person without permission.

We use a combination of automated systems and a team of moderators to monitor and review accounts and messages for content that indicates breaches of these Terms. We reserve the right at our sole discretion to terminate or suspend any Account, restrict access to the CommunityCX Platform , or make use of any operational, technological, legal or other means available to enforce the Terms (including without limitation blocking specific IP addresses), at any time without liability and without the need to give you prior notice. Without limiting the foregoing in any way, we expressly reserve the right to terminate or suspend your Account without notice (1) for violating these terms, (2) due to your conduct on the CommunityCX Platform, or your conduct with other users of the CommunityCX Platform (including your “offline” conduct), if we, in our sole discretion, determine your conduct was inappropriate or improper, (3) if we or our affiliates, in our or their sole discretion, determine your conduct on other apps operated by our affiliates was inappropriate or improper, or (4) for any reasons whatsoever that we deem, in our sole discretion, justifies termination. If your Account is terminated or suspended, you agree you will not receive a refund for any paid service or features you have already been charged for.

You may not access, tamper with, or use non-public areas of the CommunityCX Platform or our systems. Certain portions of the CommunityCX Platform  may not be accessible if you have not registered for a membership.

By using the CommunityCX Platform, you consent to submit your personally identifiable information including sensitive personal data if opted for our paid membership, Identity proofs if submitted, etc to collect, process, display and use the said information to provide the service and to contact you by other users. If you have any objection in collecting/processing your personal data, we advise you not to use CommunityCX Platform.

In order for you to be able to use the CommunityCX Platform and our services you will need to meet certain eligibility criteria. In this regard, please note that you agree and acknowledge that we will act on your behalf to enable you to provide your information to our partner third party vendors and you may have to sign additional documentation recording the same. The User must answer all questions raised on the CommunityCX Platform or otherwise by CommunityCX in relation to the services in an honest manner. Further, the User will need to apply from her own primary device and applying from another device would amount to a violation of these Terms of Use.

CommunityCX may upon its sole discretion choose to not forward the application to our partner third party vendors for processing. CommunityCX shall have the right but not the obligation to provide the reason for its decision to the User.

You acknowledge and agree that a variety of third party vendors are involved in the carrying out of a number of functions in relation to the processing of your membership application, the verification of your identity, the payment and that you may have to sign up to separate contractual terms with these vendors, and that these vendors will remain, to the extent legally permissible, liable to you for their activities and services. You may read the terms and conditions of these third parties, and you may have to sign up to some of these terms and conditions. 

The CommunityCX Platform also allows Users who meet eligibility requirements to join events, play quizzes, avail offers, take surveys and assessments.

In the event of your noncompliance, fraud or other inappropriate activity, we may cancel or invalidate your eligibility, accounts registrations and prevent your access to and use of the CommunityCX Platform. Without limiting the generality of the other provisions of the Terms of Use, the following requirements apply to your use of the CommunityCX Platform: 

  1. Access to assessments. You may receive invitations to complete   assessments by CommunityCX or you may receive no such assessments at all. 
  2. Access to surveys. You may receive invitations to complete surveys frequently up to the quotas set by CommunityCX or you may receive no invitations at all. After completing a given survey, you may experience a gap of some number of days before another survey invitation is offered. While every attempt is made to send you invitations frequently up to the desired frequency, due to various factors, you may not receive as many invitations to participate in surveys as you would like. Note that CommunityCX under no obligation to offer any specific or minimum number of survey invitations whatsoever.
  3. Non-Use and Non-disclosure. Information and content made available to you via the CommunityCX Platform may contain trade secrets or other confidential or proprietary information of our suppliers or licensors. You must hold in strict confidence and not disclose to any other person any information and content that you access or learn in connection with your participation in any survey, project, questionnaire, assessments or other market research activity related to the CommunityCX Platform. You must not use any such information or content for any purpose other than your use of the CommunityCX Platform in accordance with the Terms of Use. You hereby agree to notify us immediately if you learn of or suspect any use or disclosure of, or access to, any such information or content other than as specifically authorized in the Terms of Use.
  4. Registration Information. You agree to (a) provide true, accurate, current and complete information about you as may be prompted by any registration forms on the CommunityCX Platform; (b) maintain the security of your password and login credentials; and (c) maintain and promptly update your registration and KYC information and any other information you provide to us, so as to keep it true, accurate, current and complete. Registration requires information that includes without limitation your full legal name, your date of birth, the address of your primary residence, your phone number and your functioning email address.

You agree that if you provide any information that is untrue, inaccurate, not current or incomplete, including without limitation, quiz, assessment and survey responses that are inconsistent with prior responses or statistically improbable or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with these Terms of Use, we shall have the right to indefinitely suspend or terminate or block access of your membership or delete the content you have published on the CommunityCX Platform. You can access and update much of the information you provided us with in the Profile tab and your respective messages of the CommunityCX Platform. 

We reserve the right to terminate your account or restrict access to the CommunityCX Platform at our sole discretion, including but not limited to violations of these Terms of Use. Upon termination or suspension of your account, any content you have uploaded or submitted to the CommunityCX Platform may be deleted without prior notice. We are not responsible or liable for the deletion, loss, or inability to retrieve any content associated with your account following termination or suspension. It is your responsibility to ensure that you have backup copies of your content before uploading it to the CommunityCX Platform.

We reserve the right to refuse access to the CommunityCX Platform, terminate accounts, remove or edit content at any time without notice to you, and our partner third party vendors would handle any transaction already entered into in accordance with their policies in relation to the same.

  1. Multiple Accounts. You may have only one active account at any time. Only one account per individual and per mailing address is allowed. Multiple accounts for any person or mailing address are subject to termination.
  2. Appropriate Communications. If you communicate with any of our personnel (Personnel), you agree to do so in a respectful and appropriate manner. You shall not send, upload, share or otherwise distribute to Personnel, Personnel affiliates or other users of the CommunityCX Platform any rude or offensive communications or any content that is obscene, vulgar, sexually-oriented, shock-oriented, threatening, hateful, illegal or otherwise inappropriate. This includes, but is not limited to, communications or content that promotes religious, cultural, racial, or gender bias, or any material that may incite violence, discrimination, or harassment of any kind.

4. CHARGES

We do not charge any fee for browsing and using the CommunityCX Platform however, the membership and events on the CommunityCX Platform are paid and will be intimated to the user as and when required. We reserve the right to change our fee policy from time to time. In particular, we may, at our sole discretion, introduce new services and modify some or all of the existing services offered on the CommunityCX Platform. In such an event we reserve the right to introduce fees for the new services offered or amend/introduce fees for existing services, as the case may be. Changes to our fees policy shall be posted on the CommunityCX Platform and such changes shall automatically become effective immediately after they are posted on the CommunityCX Platform. You shall be solely responsible for compliance of applicable law, in India or otherwise.

We may offer products and services for purchase on the CommunityCX Platform(“In-Platform Purchase”). If you choose to make an In-Platform Purchase, you acknowledge and agree that additional terms, disclosed to you at the point of purchase, may apply, and that such additional terms are incorporated herein by reference.

In general, payments once made, are not refunded under any circumstances. In other words, you do not have the option of cancelling or getting a refund for any payment. It follows that you will not be getting a refund for any payment when your membership is terminated. 

5. USER CONTENT

We do not presently permit all the Users to host, upload, publish, transmit or share content on the CommunityCX Platform. Only Users, falling into the category of Community Builders, are allowed to publish content subject to the terms set out in these Terms of Use and updated from time to time. However, we may permit this in the future subject to the terms set out in these Terms of Use.

You shall be responsible for any notes, messages, reviews, emails, billboard postings, photos, drawings, profiles, opinions, ideas, images, videos, audio files or other materials or information posted or transmitted by you, or on your behalf, to the CommunityCX Platform (collectively, User Content).

It is possible that other Users (including unauthorized users or “hackers”) may post or transmit offensive or obscene materials on the CommunityCX Platform and that you may be involuntarily exposed to such offensive and obscene materials. It also is possible for others to obtain personal information about you due to your use of the CommunityCX Platform, and that the recipient may use such information to harass or injure you. We do not approve of such unauthorized uses, but by using the CommunityCX Platform, you acknowledge and agree that we are not responsible for the use of any personal information that you publicly disclose or share with others on the CommunityCX Platform. Please carefully select the type of information that you publicly disclose or share with others on the CommunityCX Platform.

Please be advised that any User Content posted does not reflect our views. In no event shall we assume or have any responsibility or liability for any User Content posted or for any claims, damages or losses resulting from use of User Content and/or appearance of User Content on the CommunityCX Platform.

You hereby represent and warrant that all the intellectual property contained in the User Content solely belongs to you or you have all necessary rights, licenses and permissions (i) in and to all User Content which you provide and all information it contains, and (ii) for the use of the CommunityCX Platform and that are needed to comply with these Terms of Use,  and that such User Content shall not infringe any proprietary, intellectual or other rights of third parties or contain any libelous, tortious, or otherwise unlawful information.

Except as expressly provided in these Terms of Use, no part of the CommunityCX Platform and no User Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way (including “mirroring”) to any other computer, server, website or other medium for publication or distribution or for any commercial enterprise, without our express prior written consent.

You may use information on the products and services purposely made available on the CommunityCX Platform for downloading, provided that you (i) do not remove any proprietary notice language in all copies of such documents, (ii) use such information only for your personal, non-commercial informational purpose and do not copy or post such information on any networked computer or broadcast it in any media, (iii) make no modifications to any such information, and (iv) do not make any additional representations or warranties relating to such documents.

We reserve the right, but have no obligation, to monitor the materials posted on the CommunityCX Platform, and remove any User Content that in our sole discretion violates, or is alleged to violate, any applicable law or either the spirit or letter of these Terms of Use. Notwithstanding this right, YOU REMAIN SOLELY RESPONSIBLE FOR THE CONTENT OF THE MATERIALS YOU POST ON THE COMMUNITYCX PLATFORM AND IN YOUR PRIVATE MESSAGES. WE SHALL NOT, UNDER ANY CIRCUMSTANCE, BE RESPONSIBLE FOR THE ACCURACY, COMPLETENESS, APPROPRIATENESS, OR LEGALITY OF THE USER CONTENT OR ANY OTHER INFORMATION YOU MAY BE ABLE TO ACCESS WHILE USING THE COMMUNITYCX PLATFORM.

We shall have all the rights to take necessary action and claim damages that may occur due to your involvement/participation in any way on your own or through group/s of people, intentionally or unintentionally in DoS/DDoS (Distributed Denial of Services).

6. PRIVACY

We view protection of your privacy as a very important principle. We understand clearly that your personal information is very important to you. We store and process your information including any sensitive financial information collected, if any, on computers that may be protected by physical as well as reasonable technological security measures and procedures in accordance with applicable law and our Privacy Policy. 

We and our affiliates may share / sell / transfer / license / convey some or all of your personal information with another business entity should we (or our assets) plan to merge with or are acquired by that business entity, or re-organization, amalgamation, restructuring of business or for any other reason whatsoever. Should such a transaction or situation occur, the other business entity or the new combined entity will be required to follow a suitable privacy policy with respect to your personal information. complying at the very least with the requirements under the applicable law. Once you provide your information to us, you provide such information to us and our affiliate and we and our affiliate may use such information to provide you various services with respect to your transaction, whether such transactions are conducted on the CommunityCX Platform or with a third-party merchant or on such third-party merchant’s website.

7. USER OBLIGATIONS AND RESPONSIBILITIES

You agree that while using the CommunityCX Platform, you shall not host, post, upload, display, publish, transmit, update or share any material or information that: (i) belongs to another person or organisation or copyrighted content and to which you do not have any right to; (ii) is grossly harmful, harassing, blasphemous defamatory, obscene, pornographic, paedophilic, libellous, invasive of another’s privacy, hateful, or racially, culturally, religious, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever; (iii) harms minors in any way; (iv) infringes any patent, trademark, copyright or other proprietary rights; (v) violates any law for the time being in force; (vi) deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature; (vii) impersonate another person; (viii) contains software viruses worms, trojans, logic bombs, or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of the CommunityCX Platform or any part thereof, or any computer resource; (ix) threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation.

Any violation of this clause may lead to the immediate suspension of your account. In the event, we receive any complaint that any information stored or used by you amounts to a breach of this clause, we will take such steps necessary as required under law to remove or disable access to such information and may disable your access to the CommunityCX Platform immediately at its sole discretion. You hereby agree to indemnify and hold harmless CommunityCX, its officers, directors and representatives against any claim or loss suffered by us as a result of a breach of this Clause.

8. UNAUTHORIZED ACCESS

Unauthorized use of any part of the CommunityCX Platform and/or our systems, including, but not limited to, unauthorized entry into and/or any attempted access of any restricted areas of the CommunityCX Platform, misuse or sharing of passwords or any other confidential information, is strictly prohibited.

Each User agrees to not use the CommunityCX Platform or any part thereof in any manner that could damage, disable, overburden, or impair the CommunityCX Platform or any part thereof, or any services offered through the CommunityCX Platform, or any other person’s access, use or enjoyment of the CommunityCX Platform or any services offered through the CommunityCX Platform.

Each User agrees to not gain or attempt to gain, unauthorized access to the CommunityCX Platform or any part thereof, through hacking, password-mining, crawling, “screen-scrape”, “data-scrape”, “data-mine”, or through any other means circumvent the navigational structure or presentation of the CommunityCX Platform, and/or use any manual or automated means to acquire data and/or information from the CommunityCX Platform, or engage in any activities that are contrary to the Terms of Use and/or any applicable law.

We reserve the right to suspend or cancel your login credentials, even without receiving such notice, if we suspect that they are being used in an unauthorized or fraudulent manner.

Each User agrees that we may, in our sole discretion and to the extent permitted by applicable law, access, read, preserve and disclose their account information, usage history and any information, document or material submitted, or otherwise made available, by such User to us, in order to: (i) comply with applicable law, regulations, legal processes, or requests from governmental or other regulatory authorities; (ii) respond to claims that any such information, document or material violates the rights of third parties, including, but not limited to, intellectual property rights or contractual rights; (iii) enforce the Terms of Use and investigate potential violations thereof; (iv) detect, prevent, or otherwise address fraud, security, or technical issues; (v) respond to your requests for any service; or (vi) protect the rights, property, or personal safety of us or the other Users.

9. ACCOUNT SECURITY

We do not guarantee or warrant that any User Content that you store or access through the CommunityCX Platform will not be subject to any inadvertent damage, corruption, loss or removal in accordance with these Terms of Use. You agree that we shall not be responsible for such loss, damage or removal and it is your sole responsibility to maintain alternate backups of the User Content. Provided that we will ensure the security of any sensitive personal information contained in the User Content in accordance with the Privacy Policy.

If you use the CommunityCX Platform, you are responsible for maintaining the confidentiality of your username and password. You agree to accept responsibility for all activities and transmissions that occur under your account. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorized manner. We will not be liable for any loss or damage arising from your failure to comply with this provision.

10. DISRUPTION

We make no guarantee as to availability, quality or service levels of the CommunityCX Platform on a 24×7 basis, or promise uninterrupted access to the CommunityCX Platform. Disruption of the CommunityCX Platform may arise due to technical or operational difficulties, and no prior notice of downtime will be given to you in such circumstances. We may also suspend the access to the CommunityCX Platform for specific users permanently or temporarily for any reason whatsoever, including while investigating complaints or alleged violations of these Terms of Use, or disable access to the CommunityCX Platform for such users.

You acknowledge, agree and accept that you may be required to update your systems, browser/mobile applications periodically in order to avail all the features and upgrades of the CommunityCX Platform.

Our services may be made available to you through third-party platforms and services such as Google Play Store, Apple App Store, Amazon Web Services (AWS), and other similar external technology platforms. Your access to and use of our services is also subject to the terms, conditions, and policies of these third-party platforms. By using our services, you agree to comply with the applicable terms and conditions of such third-party platforms, including, but not limited to, their user agreements, privacy policies, and any other applicable guidelines. We are not responsible for any issues, limitations, or interruptions that may arise due to the actions, omissions, or policies of these third-party platforms.

11. OTHER TERMS AND CONDITIONS

You will use the CommunityCX Platform for lawful purposes only and comply with all applicable laws and regulations while using the CommunityCX Platform.

You will provide authentic and true information in all instances where any information is requested of you.

If at any time, the information provided by you is found to be false or inaccurate (wholly or partly), we shall have the right in our sole discretion to disable your access to the CommunityCX Platform without any prior intimation whatsoever, and without any liability to you.

You acknowledge and agree that we have no relationship with you other than to use of the CommunityCX Platform in accordance with the Terms of Use.

12. INTELLECTUAL PROPERTY RIGHTS

The software and other technology we use to provide the CommunityCX Platform, and all material posted or available on, or otherwise accessible through, the CommunityCX Platform, including notes, messages, reviews, emails, billboard postings, photos, drawings, profiles, opinions, ideas, images, videos, audio files or other materials or information, images, illustrations, audio clips, and video clips contains copyrighted material, trademarks, and other proprietary information owned by us, the Users, other persons, or their respective licensors. Except for that information which is in the public domain or for which you have been given permission, you agree not to copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information. Access to or use of the CommunityCX Platform does not confer and should not be considered as conferring upon anyone any license to our or any third party’s intellectual property rights. Any use of the CommunityCX Platform without our permission is prohibited.

You agree that by accessing and continuing to access or use the CommunityCX Platform you explicitly give us the permission to use the User Content other than any personal or sensitive personal information (which will continue to be governed by our Privacy Policy, so that we are not violating any rights you might have in the User Content. You agree to grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, fully sub-licensable (through multiple tiers) right to exercise the copyright, publicity, database rights or any other rights you have in the User Content, in any media now known or not currently known, with respect to the User Content.

We shall be entitled to, subject to and consistent with this Terms of Use, and the Privacy Policy, as adopted in accordance with applicable law, use the User Content or any of its elements for any type of use forever, including but not limited to promotional and advertising purposes and in any media whether now known or hereafter devised, including the creation of derivative works that may include the User Content, and you acknowledge, agree and accept that you are not entitled to any acknowledgement, attribution, payment or other compensation for such use of the User Content.

We respect the intellectual property of others. Subject to the provisions of this Clause 12, in case you feel that your trademark, copyright, or any other intellectual property has been infringed, you can write to us at hello@communitycx.net. 

13. REFERRALS

Only if applicable, you can avail the benefits of our referral program, details and terms of which will be published in due course.  

14. THIRD PARTY USE AND DISPUTES

We do not guarantee that other Users of the CommunityCX Platform will comply with these Terms of Use. You hereby assume all risk of any harm or injury which may result to you on account of such non-compliance by third party users. We shall not be held responsible for any such harm or injury resulting from third party use. You hereby agree to use the CommunityCX Platform at your sole risk and judgment and acknowledge that we shall not be responsible for any User Content or other content that may be deemed illegal, infringing, offensive, indecent, or objectionable.

We do not guarantee the content of any third-party sites that you may access while using the CommunityCX Platform and do not make any representations regarding the content or accuracy of material on such sites. If you access a link of any third-party website, you hereby acknowledge that you do so entirely at your own risk and expense.

Any dispute between you and any other third party arising out of the use of the CommunityCX Platform shall not be our responsibility or liability. We shall not be held liable for any negligent conduct or behaviour, whether actions or omissions, of any third party in relation to the use of the CommunityCX Platform. We encourage you to report any complaints about the CommunityCX Platform by contacting hello@communitycx.net, and we shall take appropriate action as soon as reasonably possible.

15. INDEMNITY

You hereby agree to keep and hold us, our affiliates, group companies, and their respective directors, officers, employees, consultants and agents, fully indemnified and harmless from and against all claims, proceedings, penalties, damages, losses, actions, costs and expenses arising out of or in relation to the use of the CommunityCX Platform by you; the infringement of any third-party intellectual property rights, or the breach of these Terms of Use; or violation of any applicable law, rules or regulations or the rights of a third party or any breach of your representations and warranties set forth above and/or any fraudulent act on your part. Our right to be indemnified shall survive the expiry or termination of these Terms of Use.

You further agree to keep and hold us, our affiliates, group companies, and their respective directors, officers, employees, consultants and agents, fully indemnified and harmless from and against all any third party claims, damages (actual and/or consequential), actions, proceedings, demands, losses, liabilities, costs and expenses (including reasonable legal fees) suffered or reasonably incurred by us arising as a result of, or in connection with:

  1. any misrepresentation, negligent acts, omissions, fraud, or wilful concealment and misconduct;
  2. your access to and use of the CommunityCX Platform;
  3. the uploading or submission of content to the CommunityCX Platform;
  4. any breach of these Terms of Use; 
  5. violation of any law or of any rights of any third party;
  6. any misuse of the CommunityCX Platform and services for any illegal or unauthorized purposes;
  7. any injuries to persons or damage to property, body, business character, reputation including theft, resulting from your acts or omissions; and/or
  8. any claims by a third party on us for the acts committed or omitted by you.

16. DISCLAIMER AND LIMITATION OF LIABILITY

WE PROVIDE THE COMMUNITYCX PLATFORM ON AN “AS IS” BASIS AND GRANTS NO WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE WITH RESPECT TO THE COMMUNITYCX PLATFORM. WE SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. YOU EXPRESSLY AGREE THAT THE USE OF THE COMMUNITYCX PLATFORM IS AT YOUR OWN RISK.

IN NO EVENT SHALL WE OR OUR AFFILIATES BE LIABLE FOR ANY DAMAGES OF ANY KIND, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, WHETHER BASED ON BREACH OF CONTRACT, BREACH OF WARRANTY, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

WE GRANT NO WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE WITH RESPECT TO THE THIRD PARTY VENDORS THAT ARE INVOLVED IN THE PROCESSING OF THE PAYMENT INCLUDING THOSE THAT ARE INVOLVED IN THE VERIFICATION OF THE USERS’ IDENTITY, THE ASSESSMENT OF THE USERS’ CREDIT HISTORY AND THE PAYMENT AND REPAYMENT. IN NO EVENT SHALL WE BE LIABLE FOR YOUR USE OR NON-USE OF THEIR SERVICES AND ANY DAMAGES THAT MAY ARISE FROM SUCH USE OR NON-USE. WE SHALL NOT BE LIABLE FOR ANY DIRECT, SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND IN CONNECTION WITH THE ACTS OR OMISSIONS OF SUCH THIRD PARTIES. YOU EXPRESSLY AGREE THAT THE USE OR NON-USE OF THEIR SERVICES IS AT YOUR OWN RISK.

17. TERMINATION

Notwithstanding anything contained in the Terms of Use, we reserve the right to discontinue or to terminate your license to use the CommunityCX Platform, to delete any Panel registrations or other accounts, and to restrict, block, limit, and prevent your access to and use of the CommunityCX Platform. All payments already made will be governed by the policies of the relevant partner third parties in this regard. Any termination or other action by us described herein shall not limit any other remedies available to us at law, equity or otherwise.

Any violation or breach of the Terms of Use may lead to automatic suspension or termination of your account or access to the CommunityCX Platform by us, and we shall not be responsible or liable for damages in this regard.

The termination of the Terms of Use will not affect any liability that may have arisen under the Terms of Use prior to the date of termination.

If you do not participate in any assessment or survey during a selected extended time period, we  may elect, in our sole discretion, to terminate your access/account without notice. Other grounds for termination without notice include providing inadequate or untruthful assessment or survey responses or if you are not contactable on the phone number listed and you having undeliverable e-mail address or mailboxes that are full after multiple attempts to contact you. You hereby waive and release any and all claims against us, our affiliates, arising from or related to such membership termination. 

18. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms of Use shall be governed by the laws of India and any disputes or proceedings arising hereunder shall be subject to the exclusive jurisdiction of the courts in New Delhi.

19. SEVERABILITY

If any provision of the Terms of Use is held to be invalid or unenforceable, then such provision shall (so far as it is invalid or unenforceable) be given no effect and shall be deemed not to be included in the Terms of Use but without invalidating any of the remaining provisions of the Terms of Use.

20. MISCELLANEOUS

You may not assign, transfer or sublicense any or all of your rights or obligations under the Terms of Use without our prior written consent. Any such attempted assignment, transfer or sublicense shall be void. We may assign, transfer or sublicense any or all of our rights or obligations under this Terms of Use without restriction. Notwithstanding the preceding sentence, we shall not assign our rights or obligations under the Terms of Use in a manner that is detrimental to you.

Any heading, caption or section title contained herein is inserted only for convenience, and in no way defines or explains any section or provision hereof.

Notices to you may be made via posting to the CommunityCX Platform, by e-mail, or by regular mail, at our discretion. Without limitation, you agree that a printed version of the Terms of Use and of any notice given hereunder in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to the Terms of Use to the same extent and subject to the same conditions as other documents and records originally generated and maintained in printed form.
